Welcome to Bildfie. These Terms of Service ("Terms") are the agreement between you and Bildfie. They cover your use of the Bildfie website, the Bildfie app and every service we offer on them (together, the "Service"). By creating an account or using the Service, you agree to these Terms.

Some parts of Bildfie have their own extra terms. When you use those parts, the extra terms apply too. They are listed in Other terms that apply. Our Privacy Policy explains how we handle your information. It is not part of this agreement, but please read it.

1.Who we are and what we do

In shortBildfie is an online platform where people hire, work, buy, sell, rent, learn and raise money together. We provide the tools; the deals are between members.

Bildfie is operated from Ol Rongai, Nakuru, Kenya. It brings together clients, skilled professionals, employers, job seekers, sellers, buyers, landlords, tenants, teachers, learners and groups, in every trade and industry and in every country where the Service is available.

On Bildfie you can:

We are not an employer, an agent, an estate agent, a school, a bank or a party to the agreements members make with each other, unless a page clearly says otherwise. When you hire someone, buy something or rent a place through Bildfie, the agreement is between you and the other member. We provide the platform, hold money in escrow where the Service says so, and help when something goes wrong.

2.Who can use Bildfie

In shortYou must be 18 or older to have your own account. Children can learn on Bildfie only through a parent or guardian.
  • You must be at least 18 years old and able to make a binding contract where you live.
  • Children under 18 may use the learning parts of Bildfie only through an account linked to a parent or guardian, as set out in Children & Young People and Learn Terms.
  • You may not use Bildfie if we have closed your account for breaking these Terms, unless we have restored it (see Suspending and closing accounts).
  • You may not use Bildfie if the law forbids you from receiving our services, including under sanctions.
  • If you use Bildfie for a business or organisation, you confirm that you are allowed to act for it, and these Terms bind it too.

3.Your account

In shortGive true information, keep your sign-in, PIN and signature safe, and tell us at once if someone else gets into your account.
  • One person, true details. Use your real name and true details. Your full name is kept private: other members see your first name, and your full name appears only on agreements, receipts and certificates that need it.
  • Keep it safe. You are responsible for activity on your account. Keep your password, transaction PIN and signature image to yourself. Do not let anyone else use your account.
  • Identity checks. We may ask you to verify your identity with an ID document and a selfie before you can use some features, receive money or have a badge. We keep these privately (Privacy Policy).
  • Tell us quickly. If you think someone else has used your account, use "Not you?" in the alert we send, or contact us at support@bildfie.com. We can sign every device out and help you recover the account (Account Safety & Security).
  • Business profiles and skill sets. One account can hold up to three skill sets and can belong to companies. Each company page must be for a real business you are allowed to represent.

4.Your content

In shortWhat you post stays yours. You give us permission to show it on Bildfie so the Service can work, and you promise you have the right to post it.

"Content" means anything you post or upload: project briefs, bids, messages, photos, CVs, listings, reviews, courses, files and more.

  • You own it. You keep the rights you have in your content.
  • Permission you give us. You give Bildfie a worldwide, non-exclusive, royalty-free licence to host, store, copy, show, adapt (for example, resize a photo or turn a CV into plain text) and share your content, only to run, improve and promote the Service. The licence ends when you delete the content or your account, except where others have already received it (for example, a message you sent) or where we must keep records (Privacy Policy).
  • Your promise. You have the right to post the content, it is true, and it follows these Terms and the Community Standards.
  • Signed documents. Agreements, receipts and certificates you sign or receive on Bildfie are sealed when signed and cannot be changed or deleted afterwards. This protects both sides.
  • Our right to remove. We may remove or limit content that breaks these Terms or the law, or that puts members at risk.

5.Keeping contact on Bildfie

In shortMembers talk and do business through Bildfie. Sharing phone numbers, emails, social links or other outside contacts is not allowed, unless our staff approve a detail you send for review.

All communication and business between members happens on Bildfie, through in-app messages and the tools on each page. This keeps payments protected, records complete and everyone safe.

  • You must not share, ask for or publish phone numbers, email addresses, WhatsApp, Telegram or other messaging handles, social-media profiles, outside websites, payment numbers (till, paybill, account) or any other way to reach someone outside Bildfie. This includes disguised forms, such as numbers written in words or spaced out.
  • Our system checks text before it is sent. It looks at the words around a number, so prices, sizes, serial numbers, order numbers and plot numbers are not treated as contacts.
  • If your text is stopped, nothing is sent and your text stays with you to edit. If you believe a detail must stay (for example, a public office line or a number that is not a contact at all), you can send it for review. Our staff will approve it, for you or for everyone, or decline it. Sending something for review never counts against you.
  • Repeatedly trying to send contact details, after 5 tries on a page, counts as one attempt. After 14 attempts the account is closed, as described in the Community Standards.

Addresses for a property, a delivery or an in-person meeting are allowed where the page asks for them.

6.Payments, fees and the wallet

In shortMoney moves through your Bildfie wallet and M-Pesa. Work and many sales are paid through escrow. We charge a commission that is shown before you pay.
  • Wallet. Your Bildfie wallet holds money you top up by M-Pesa and money you earn. The smallest top-up is KES 50.
  • Escrow. For projects, many sales, deposits and course sessions, money is set aside and released only when the agreed step is done, as explained in the Payments & Wallet Terms.
  • Commission. Each kind of income (projects, shop orders, marketplace sales, property, courses and others) has its own commission rate. The rate is shown before you pay or accept, and is deducted from the amount released to the person receiving it.
  • Transaction PIN. Seeing your balance and sending money out need your transaction PIN.
  • Taxes. You are responsible for any taxes on the money you earn on Bildfie, unless the law says we must collect them.
  • Paying outside Bildfie. Paying or asking to be paid outside Bildfie for a deal that started on Bildfie is not allowed. It removes your protection and is a breach of these Terms.

The full rules, including withdrawals, failed payments and mistakes, are in the Payments & Wallet Terms. Refunds and disputes are covered by the Disputes & Refunds Policy.

7.What you must not do

In shortDo not break the law, cheat other members, misuse the Service or try to get around our protections.

You must follow the Community Standards. In particular, you must not:

  • post false projects, jobs, listings, bids, reviews or identities, or pretend to be someone else;
  • scam, threaten, harass or discriminate against anyone;
  • sell or advertise anything illegal or listed as prohibited in the Selling & Marketplace Policy;
  • move a deal or payment off Bildfie, or share contact details (see Keeping contact on Bildfie);
  • use someone else's work without permission (Intellectual Property Policy);
  • scrape, copy, overload, break into, reverse-engineer or test the security of the Service without our written permission;
  • use automated accounts, bots or scripts, except tools we provide;
  • create a new account to get around a closure or a limit.

8.Our role between members

In shortWe check some things, but we cannot check everything. Take care, use the tools on Bildfie and report problems.

We screen some posts before they go live, check identities when members verify, review courses before they are published and decide disputes about money held in escrow. But we do not control or guarantee:

  • the quality, safety or legality of work, items, property or courses offered by members;
  • that members will complete a deal, or that what they say is true;
  • that a job, project or listing will get a result.

Use the protections we provide: pay through escrow, keep conversations on Bildfie, read reviews, and report anything that seems wrong. A certificate of completion from a course shows that the learner finished the course. It is not a qualification or a licence.

9.Suspending and closing accounts

In shortYou can close your account at any time. We may limit, suspend or close accounts that break these Terms, and you can appeal.
  • You. You may stop using Bildfie and ask us to close your account at any time. Money in your wallet and open deals must be settled first.
  • Us. We may remove content, limit features, suspend or close an account if it breaks these Terms or the law, puts members at risk, or if we must do so by law. Where we can, we tell you why in our notice and how to appeal.
  • Closed accounts. A closed account cannot be used, and while it is closed no new account can be opened with the same email or phone number.
  • Appeals. You can appeal a closure. If we restore your account, it may be on probation for up to 6 months, as described in the Community Standards.
  • Records. Even after closing, we keep the records the law requires, such as payments and signed documents (Privacy Policy).

10.Disclaimers and limits of our liability

In shortWe provide the Service with care, but as it is. Our liability is limited as far as the law allows. Nothing here takes away rights the law gives you as a consumer.

We work hard to keep Bildfie safe, available and accurate. Even so, the Service is provided "as is" and "as available". As far as the law allows, we do not promise that it will always be available, free of errors or suitable for a particular purpose.

As far as the law allows:

  • we are not liable for losses caused by other members, by events outside our reasonable control, or that were not foreseeable;
  • we are not liable for indirect or consequential losses, or lost profits, revenue or data;
  • our total liability for any claim about a deal is limited to the commission we kept on that deal, and for any other claim to the fees and commission you paid us in the 12 months before the claim.

These limits do not apply where the law does not allow them, including for death or personal injury caused by our negligence, or for fraud. If you are a consumer, you keep all the rights consumer-protection law gives you.

Indemnity. If someone brings a claim against Bildfie because of content you posted, a deal you made or your breach of these Terms or the law, you agree to cover our reasonable costs and losses from that claim, as far as the law allows.

11.Disagreements and the law that applies

In shortTalk to us first. Kenyan law applies, and the courts of Nairobi decide, unless your local consumer law gives you other rights.
  • Between members. Problems with a deal paid through escrow are decided under the Disputes & Refunds Policy.
  • With us. If you have a complaint about Bildfie, contact us at support@bildfie.com. We will try to resolve it within 30 days.
  • Law and courts. These Terms are governed by the laws of the Republic of Kenya. The courts of Nairobi decide any dispute that we cannot resolve, unless the law of the country where you live as a consumer gives you the right to go to your local courts.

12.Changes to these Terms

In shortWe will tell you at least 14 days before an important change takes effect.

We may update these Terms as the Service and the law change. When a change is important, we will tell you by email or in the app at least 14 days before it takes effect. The date at the top of this page shows the latest version, and earlier versions are listed at the bottom. If you keep using Bildfie after a change takes effect, the new Terms apply. If you do not agree, you can close your account.

13.Other terms that apply

In shortExtra terms apply to each part of Bildfie you use. If they conflict with these Terms on that subject, the extra terms win.

14.General

In shortThe usual legal points about how this agreement works.
  • These Terms, with the other terms that apply, are the whole agreement between you and us about the Service.
  • If a part of these Terms cannot be enforced, the rest still applies.
  • If we do not enforce a part of these Terms straight away, we can still enforce it later.
  • You may not transfer your rights under these Terms without our consent. We may transfer ours, for example if Bildfie is reorganised, and we will tell you.
  • Notices to us: support@bildfie.com. Notices to you: by email, in the app or on your notifications page.
